Sales conditions

Paris Oise Enchères is a voluntary furniture auction company governed by the law of 10 July 2000 and registered under number 2010-743. In this capacity, Paris Oise Enchères acts as the agent of the seller who contracts with the buyer. The relationship between Paris Oise Enchères and the buyer is subject to these terms and conditions. The sale will be made expressly in cash. The sale will be conducted in French, and Paris Oise Enchères is not responsible for any automatic translations. The highest bidder and last bidder will be required to pay in cash and provide their name and address.

I/ When the property is put up for sale:

1/ During the exhibition period, potential buyers are invited to examine the lots in which they are interested. Paris Oise Enchères is available to provide potential buyers with condition reports on the lots offered for sale.

2/ The descriptions of the lots in the catalogue, labels and other indications or verbal announcements are merely Paris Oise Enchères' expression of its perception of the lot, but do not constitute any proof of fact.

3/ Estimates are provided for information purposes only

4/ No claims will be accepted for normal wear and tear or minor accidents, as the public exhibition has allowed the works offered for sale to be examined.

5/ Any changes to the catalogue descriptions may be announced verbally or in writing during the sale and will be countersigned in the sale minutes.

6/ The auctioneer and experts are responsible for executing purchase orders entrusted to them free of charge, in particular for amateurs who are unable to attend the sale. Purchase orders are a convenience for customers. The auctioneer and expert are not responsible for failing to execute an order by mistake or for any other reason.

7/ TELEPHONE BIDS are ACCEPTED after prior confirmation in WRITING, 48 hours before the sale, and after providing proof of identity. Anyone requesting a telephone bid is obliged to purchase at the low estimate.

8/ Potential buyers are invited to visit Paris Oise Enchères before the sale to register their personal details. Paris Oise Enchères reserves the right to ask any potential buyer to provide proof of identity and bank details or to provide a bank guarantee.

II/ During the sale:

1/ Any person acting on behalf of a third party is requested to make themselves known before the sale.

2/ Any person who purchases a lot undertakes to pay personally and immediately the hammer price plus any fees payable by the purchaser and any taxes or duties that may be payable. Payment shall be made ‘in cash’.

3/ In addition to the auction price, the purchaser shall pay: 28.8% including VAT, including for books subject to 5.50% VAT.

For bidders via the Drouot Digital platform, a commission of 1.5% excluding VAT will be charged in addition to the sale costs.

For bidders via the Interencheres platform, a commission of 3% excluding VAT will be charged in addition to the sales fees for works of art and collectibles.

For bidders via the Invaluable platform, a commission of 3% excluding VAT will be charged in addition to the sales fees.

4/ Once the auction has been declared, the items are the sole responsibility of the successful bidder.

5/ All administrative formalities relating to the export of a lot are the responsibility of the successful bidder (passport, customs formalities). Successful bidders are advised to insure their lots as soon as the auction is over and to collect their lots as soon as possible in order to avoid handling and storage costs, which are their responsibility.

6/ Payment will be collected at the end of the sale.

7/ No lot will be handed over to buyers until full payment has been received. In the event of payment by cheque by the successful bidder, transfer of ownership of the item will only take place after the cheque has been cashed. Reminder: payment by cheque does not allow for immediate delivery of your lots. The delay will be 20 working days after deposit in the bank. - Cash payment for a maximum amount of €1,000 including fees and taxes for French nationals and traders. €10,000 including fees and taxes for foreign nationals accompanied by proof of residence. - Payment by bank transfer or via the secure Paris Oise Enchères website. - Payments on the slips will be net of bank charges. - No foreign cheques will be accepted.

8/ In the event of a dispute at the time of the auction, i.e. if it is established that two or more bidders have simultaneously placed an equivalent bid, either aloud or by sign, and claim the item at the same time after the word ‘sold’ has been pronounced, the item will be put back up for auction at the price offered by the bidders and the entire audience will be allowed to bid again. In the event of a double bid, priority will be given to the room. In the event of non-payment, the item may be put back up for auction immediately or at the earliest opportunity. The false bidder is liable to legal action and registration in the file of defaulters.

9/ In the event of an internet connection failure, the auctioneer is free to stop and then restart the auction. The OVV is not responsible for technical incidents.

III/ Collection of purchases:

1/ The purchaser shall be responsible for insuring their purchases. Paris Oise Enchères declines all responsibility for any damage that the item may incur once the auction has been declared.

2/ Lots must be collected by appointment in Chantilly, after checking the opening hours in advance. Delivery is by appointment with the site manager, whose contact details are listed in the catalogue.

3/ Paris Oise Enchères shall not be held liable in any way whatsoever for shopping.

4/ Purchases made at this sale are eligible for 15 days of free storage in Chantilly. After this period, storage fees will be charged to buyers at a rate of €5 per day per item or painting, €10 per day per piece of furniture and €20 per vehicle.

5/ In accordance with Article L.321-14 of the French Commercial Code, an item sold at auction may only be delivered to the buyer once the company has received payment or once it has been given a guarantee of payment by the buyer. Proof of identity will be requested before purchases are delivered. The purchaser may give power of attorney to relatives or a carrier to collect their purchases on their behalf. In this case, the purchaser must send us an email or letter with a copy of their identity card, indicating the identity of the authorised person and authorising us to deliver their purchases to them. The latter must present their own identity document.

6/ Paris Oise Enchères may provide, for information purposes, the contact details of carriers who deal directly with the purchaser. Paris Oise Enchères declines all responsibility once the items have left the place of sale.

IV/ Jewellery: Jewellery, diamonds and coloured stones accompanied by their certificates are certified. Precious and semi-precious stones are described in accordance with Decree 200-65 of 14 January 2002 on the trade in gemstones and pearls. Thus, stones modified by traditional lapidary practices (such as oiling or heating coloured stones) are described in the same way as those that have not been treated (Art. 3), while stones modified by other processes are designated as ‘treated’ or by indicating the treatment undergone (Art. 2).

V/ Automobiles:

1/ Vehicles are sold as is. The exhibition prior to the sale allows potential buyers to inspect the condition of the vehicles. The information provided in the catalogue is for information purposes only and may be corrected at the time of sale, as the condition of a car may vary between the time of its description in the catalogue and its presentation for sale. No claims will be accepted after the auction has taken place.

2/ For administrative reasons, the descriptions of the vehicles are, with some exceptions, taken from the information on the registration documents.

3/ Potential buyers have taken care to read the documents relating to each vehicle.

4/ Paris Oise Enchères reserves the right to modify a vehicle description or estimate on the day of the sale, either verbally or in writing.

5/ The buyer is responsible for changing the vehicle registration, in particular in accordance with legal deadlines. 6/ Vehicles must be collected within 15 days of the sale. After this period, they remain at the risk and expense of their owner (theft, accident, fire, vandalism, etc.). Storage costs will be charged to buyers at a rate of £20 per day, including VAT.

VI/ Disputes: French law alone governs all contractual relations between the parties. The limitation period for civil liability actions against the OVV or the expert is five years from the date of the auction (third paragraph of Article L.321-17 of the French Commercial Code). The Court of Compiègne shall have sole jurisdiction in the event of a dispute. It is possible to refer the matter to the Government Commissioner in order to seek an amicable solution to a dispute.

The CVV publishes a ‘Code of Ethics’. The voluntary sales operator is a member of the Central Register for the Prevention of Unpaid Debts of Auctioneers, with which payment incidents may be recorded.
